“Same-Sex Divorces May Cost More”

I just attended a seminar on same-sex marriage issues and one of the panelists brought up some statistics from New York suggesting that same-sex divorces were more expensive. When the panel attempted to provide a rationale, it was suggested that it was because there is, so far, little common law for the Court to rely on when addressing new angles for same-sex couples for old problems of the dissolution of a marriage. In short, New York attorneys find they need to work longer hours to write more motions to deal with new circumstances, and provide more briefs to assist the judges in deciding on how to apply the laws to the new circumstances and situations. Interesting!

If you’ve been following the Tuckner case in the newspaper, you know what I mean. If you haven’t, that case serves as a good example of what happens when new application of old laws can cause special consideration and subsequently higher attorneys fees to help sort them out.
